1. Introduction

Welcome to Xtasify.

Xtasify is the brand name of the Training and Education Division of AhaLok® Technologies Private Limited.

In these Terms and Conditions:

  • “Xtasify,” “AhaLok®,” “we,” “us,” and “our” refer to AhaLok® Technologies Private Limited operating through the Xtasify brand.
  • “Website” refers to https://xtasify.com and any related landing page, course portal, registration page, or digital platform operated by us.
  • “Programme” includes any course, webinar, workshop, consultation, mentoring engagement, membership, event, digital product, community, or educational service offered under the Xtasify brand.
  • “Participant,” “learner,” “client,” “user,” “you,” and “your” refer to any person or organisation accessing the Website or purchasing, registering for, or participating in a Programme.

These Terms govern your access to and use of the Website and Xtasify services.

By accessing the Website, submitting a registration form, making a payment, joining a Programme or community, or using any Xtasify content or service, you confirm that you have read, understood, and agreed to these Terms.

If you do not agree with these Terms, you should not use the Website or register for a Programme.

2. Related Policies

These Terms must be read together with our:

  • Programme-specific registration terms;
  • Payment-page disclosures;

  • Proposals, quotations, engagement letters, or contracts; and

These documents collectively form the agreement between you and Xtasify.

Where a programme-specific written agreement contains terms that differ from these general Terms, the programme-specific terms will apply to that Programme, provided they do not restrict any rights that cannot legally be excluded.

3. Scope of Services

Xtasify may offer services including:

  • Personal-development and self-awareness programmes;
  • Life and business strategy education;
  • Leadership and professional-development programmes;
  • Meditation and mindfulness education;
  • Yoga, breathing, relaxation, and energy-awareness practices;
  • Spirituality and philosophy-based learning;
  • Vedic astrology and Vastu education or guidance;
  • Hypnotherapy-awareness and subconscious-mind education;
  • Reiki, chakra, and energy-balancing awareness;
  • Individual mentoring and consultations;
  • Group coaching and transformation programmes;
  • Corporate, institutional, university, and school programmes;
  • Recorded courses and digital learning resources;
  • Books, workbooks, audio, video, assessments, and reports;
  • Memberships and online communities; and
  • Other educational or training services communicated by Xtasify.

We may modify, expand, restrict, replace, or discontinue any service or Programme, subject to existing contractual obligations and applicable law.

4. Educational Nature of Services

Unless expressly stated otherwise in a separate written professional engagement, Xtasify services are provided for:

  • Education;
  • Training;
  • Awareness;
  • Personal development;
  • Self-reflection;
  • Mentoring;
  • General guidance; and
  • Skill development.

Xtasify does not represent that every Programme constitutes a regulated professional, medical, psychological, legal, financial, or clinical service.

Participation in a Programme does not create a doctor-patient, therapist-patient, lawyer-client, financial-adviser-client, fiduciary, employment, partnership, or agency relationship unless such a relationship is expressly established through a separate written agreement and is legally permissible.

5. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to independently purchase or register for an Xtasify Programme.

By using the Website or registering for a Programme, you represent that:

  • You are legally competent to enter into these Terms;
  • The information provided by you is accurate and complete;
  • You are not prohibited by applicable law from using the relevant service; and
  • You will comply with these Terms and all Programme instructions.

6. Participation by Children and Minors

A child or person below 18 years of age may participate only where:

  • The Programme is suitable for their age group;
  • Registration is completed or approved by a parent or lawful guardian;
  • Required parental or guardian consent has been obtained;
  • The parent or guardian provides accurate information;
  • Appropriate supervision is arranged where required; and
  • The child follows all safety and conduct instructions.

The parent or guardian remains responsible for:

  • Determining whether the Programme is appropriate for the child;
  • Disclosing relevant limitations or support requirements;
  • Supervising the child where necessary;
  • Ensuring safe participation; and
  • Making all payments and contractual decisions.

Xtasify may decline or discontinue a child’s participation where required consent, supervision, suitability, or safety conditions are not satisfied.

7. Registration and Acceptance

Submitting an enquiry or registration form does not always guarantee admission to a Programme.

Registration is considered confirmed only after:

  • The required information has been received;
  • Applicable eligibility requirements have been satisfied;
  • Payment has been successfully received, where applicable; and
  • Xtasify has issued a confirmation, access instruction, invoice, receipt, or joining communication.

We may decline a registration where:

  • The Programme is full;
  • Eligibility requirements are not satisfied;
  • Information supplied is incomplete or inaccurate;
  • Participation may create a safety or conduct concern;
  • Payment has not been completed;
  • A previous material breach remains unresolved; or
  • We are otherwise unable to provide the service.

Where we decline a paid registration before providing any service, the amount received will be addressed in accordance with our Refund & Cancellation Policy and applicable law.

8. Accuracy of Information

You must provide accurate, current, and complete information when:

  • Registering;
  • Making a payment;
  • Booking a consultation;
  • Completing an assessment;
  • Applying for a certificate;
  • Joining a community; or
  • Communicating with Xtasify.

You are responsible for updating information that becomes inaccurate or outdated.

Xtasify will not be responsible for missed communications, incorrect reports, delayed access, or other problems caused by inaccurate or incomplete information supplied by you.

9. User Accounts and Access Credentials

Some services may require an account, password, meeting link, access code, or registered email address or telephone number.

You agree to:

  • Keep access credentials confidential;
  • Use the service only for yourself or the registered participant;
  • Notify us promptly of suspected unauthorised access;
  • Not share paid access with another person;
  • Not permit simultaneous unauthorised use; and
  • Not attempt to bypass access restrictions.

You are responsible for activity carried out through your account or credentials unless the unauthorised activity occurred because of a security failure attributable to Xtasify.

We may suspend access where credential sharing, unauthorised access, piracy, or misuse is reasonably suspected.

10. Programme Information

We endeavour to describe each Programme accurately, including its:

  • Subject;
  • Intended learning outcomes;
  • Duration;
  • Schedule;
  • Delivery format;
  • Language;
  • Fees;
  • Trainer or facilitator;
  • Included resources; and
  • Eligibility requirements.

Programme descriptions are general representations of the planned learning experience. We may make reasonable changes to:

  • Session order;
  • Module titles;
  • Exercises;
  • Resources;
  • Trainer assignments;
  • Delivery platform;
  • Schedule;
  • Venue; or
  • Teaching methodology.

Such changes may be made to improve the Programme, address participant needs, maintain safety, or respond to operational circumstances.

A reasonable change that does not materially reduce the purchased service will not ordinarily constitute non-delivery.

11. Fees, Taxes and Payments

Programme fees will be communicated through the Website, registration page, proposal, invoice, or payment link.

Unless otherwise stated:

  • Fees are payable in Indian Rupees;
  • Applicable taxes may be charged separately or included in the displayed price;
  • Registration is not confirmed until payment is received;
  • Participants are responsible for bank, card, currency-conversion, or international transaction charges;
  • Payment must be made through an authorised method; and
  • Xtasify may use third-party payment gateways.

You authorise Xtasify and its payment service providers to process the information necessary to complete the transaction.

We do not ordinarily receive or store complete card, bank-account, UPI PIN, or authentication credentials.

12. Instalment Plans

Where an instalment facility is offered:

  • The facility relates to the total price of the Programme;
  • It does not convert the Programme into separate pay-per-session purchases;
  • Instalments must be paid by the stated due dates;
  • Access may be suspended for overdue payments;
  • Outstanding amounts may remain payable after voluntary withdrawal; and
  • Any cancellation or refund will be governed by the applicable programme terms and Refund & Cancellation Policy.

Failure to attend or complete a Programme does not automatically cancel remaining instalments.

13. Pricing Errors and Promotional Offers

We may correct genuine pricing, typographical, or technical errors.

Where a material pricing error is identified before service delivery, we may:

  • Offer the Programme at the correct price; or
  • Cancel the affected transaction and refund the amount received.

Discounts, coupons, scholarships, early-bird prices, promotional fees, and limited-period offers:

  • Are subject to their stated conditions;
  • Cannot ordinarily be applied retrospectively;
  • Cannot be exchanged for cash;
  • May not be combined unless expressly allowed; and
  • May be withdrawn before purchase.

Different participants may pay different prices because of the timing, package, geography, scholarship, promotion, or scope of their enrolment.

14. Refunds and Cancellations

Refunds, cancellations, transfers, rescheduling, no-shows, duplicate payments, and programme cancellations are governed by our separate Refund & Cancellation Policy.

By completing a purchase, you acknowledge that you have had an opportunity to review that Policy.

Programme-specific refund terms disclosed before payment will apply to the relevant purchase.

15. Delivery and Access

Programme access may be delivered through:

  • Live online sessions;
  • Physical venues;
  • Email;
  • WhatsApp or other messaging platforms;
  • Learning-management systems;
  • Video-conferencing platforms;
  • Download links;
  • Member portals;
  • Recorded videos;
  • Audio resources; or
  • Other digital platforms.

You are responsible for reviewing and following joining instructions.

You must inform us within a reasonable period if:

  • Registration confirmation is not received;
  • Access credentials do not work;
  • A purchased digital product is not delivered; or
  • A technical issue prevents access.

Failure to report an access problem promptly may limit our ability to investigate or correct it.

16. Technical Requirements

For online participation, you are responsible for maintaining:

  • A compatible device;
  • Stable internet access;
  • Current software or applications;
  • Functional speakers, microphone, and camera where required;
  • Adequate data and electricity; and
  • A private and suitable environment.

Xtasify is not responsible for disruption caused by your device, internet connection, local power supply, software settings, or failure to install required applications.

Where a substantial technical problem originates from Xtasify or its selected platform, we will take reasonable steps to provide an alternative, replacement session, recording, extended access, credit, or other appropriate remedy.

17. Live-Session Participation

During live sessions, you agree to:

  • Join using your registered name;
  • Arrive at the communicated time;
  • Follow facilitator instructions;
  • Maintain respectful conduct;
  • Avoid unnecessary disruption;
  • Protect the privacy of other participants;
  • Use appropriate language;
  • Participate from a reasonably safe environment; and
  • Avoid operating vehicles, machinery, or engaging in hazardous activity during exercises.

The facilitator may mute, remove, or restrict a participant whose conduct disrupts the session or creates a safety, privacy, or legal concern.

18. Programme Recordings

Xtasify may record certain sessions for:

  • Participant revision;
  • Programme delivery;
  • Internal quality review;
  • Trainer development;
  • Educational archives; or
  • Other purposes disclosed before recording.

Where required, participants will be informed and appropriate consent will be obtained.

A session recording may incidentally contain a participant’s:

  • Name;
  • Voice;
  • Image;
  • Questions;
  • Chat messages; or
  • Contributions.

Participants who do not wish to appear visually should follow the options communicated for that session, such as keeping the camera off or submitting questions privately, where practical.

Personally identifiable recordings will not be used for public promotion without appropriate permission.

19. Prohibition on Participant Recording

Unless Xtasify provides written permission, participants must not:

  • Audio-record or video-record sessions;
  • Take unauthorised screenshots;
  • Screen-record presentations;
  • Download protected streaming content;
  • Copy chat discussions;
  • Transcribe sessions for redistribution;
  • Photograph other participants; or
  • Publish private session content.

This restriction protects intellectual property, participant privacy, and the confidentiality of group discussions.

20. Intellectual Property Rights

All intellectual property associated with Xtasify is owned by or licensed to AhaLok® Technologies Private Limited.

Protected material may include:

  • Xtasify names, marks, logos, and designs;
  • AhaLok® names, marks, and logos;
  • The Aware Being Code;
  • The Aware Being System;
  • The Ecstasy Path;
  • Programme names and frameworks;
  • Course structures and methodologies;
  • Books and manuscripts;
  • Videos and audio;
  • Presentations and slide decks;
  • Workbooks and exercises;
  • Assessments and questionnaires;
  • Reports and templates;
  • Meditation scripts;
  • Graphics, photographs, and illustrations;
  • Website content;
  • Software and source code;
  • Recorded sessions; and
  • Other original material.

No ownership rights are transferred to you through registration, payment, participation, or access.

21. Limited Personal-Use Licence

Upon full payment and subject to these Terms, Xtasify grants you a limited, revocable, non-exclusive, non-transferable licence to use supplied learning material for your personal and non-commercial learning.

You must not, without prior written permission:

  • Copy or reproduce the material;
  • Resell, sublicense, or distribute it;
  • Conduct a programme based substantially on it;
  • Present it as your own work;
  • Upload it to public repositories;
  • Share it through WhatsApp, Telegram, cloud drives, or social media;
  • Translate or adapt it for commercial use;
  • Remove trademarks or copyright notices;
  • Use it to train an artificial-intelligence system;
  • Create derivative commercial products; or
  • Permit access by unregistered persons.

Personal notes prepared in your own words for private learning are permitted.

22. Certificates

Where a Programme includes a certificate, the certificate may be subject to:

  • Minimum attendance;
  • Completion of assignments;
  • Participation requirements;
  • Payment of all fees;
  • Assessment standards; and
  • Compliance with conduct requirements.

Unless expressly stated, a certificate:

  • Confirms participation or completion only;
  • Is not an academic degree;
  • Is not a government licence;
  • Does not establish professional registration;
  • Does not authorise regulated practice; and
  • Does not guarantee employment, promotion, income, or professional recognition.

The participant is responsible for confirming whether a certificate satisfies any employer, university, professional body, or regulatory requirement.

23. Participant Contributions

You may voluntarily submit:

  • Questions;
  • Reflections;
  • Assignments;
  • Feedback;
  • Comments;
  • Images;
  • Audio;
  • Video;
  • Case examples; or
  • Other content.

You retain ownership of your original content.

You grant Xtasify a limited right to store, process, reproduce, and use that content only as reasonably necessary to:

  • Deliver the Programme;
  • Provide feedback;
  • Maintain records;
  • Operate the learning platform;
  • Address complaints;
  • Comply with law; or
  • Fulfil another purpose for which permission was obtained.

You represent that your content:

  • Is accurate to the best of your knowledge;
  • Does not violate another person’s rights;
  • Is not unlawful, defamatory, abusive, or misleading; and
  • Does not contain material you are prohibited from sharing.

24. Testimonials and Success Stories

Testimonials, reviews, and success stories may be used publicly only with appropriate permission.

A participant who provides a testimonial is responsible for ensuring that it is truthful and reflects their genuine experience.

Testimonials represent individual experiences. They do not guarantee that every participant will achieve the same or similar result.

Any public use of a participant’s identifiable photograph, video, voice, or detailed personal story will be governed by the permission obtained and our Privacy Policy.

25. Online Communities

Xtasify may operate learning communities through WhatsApp, social media, membership platforms, or other communication services.

By joining a community, you understand that other members may be able to see information such as your:

  • Name;
  • Profile photograph;
  • Telephone number;
  • Comments;
  • Questions; or
  • Shared media.

You must not:

  • Copy another participant’s personal information;
  • Add participants to unrelated groups without consent;
  • Send unsolicited private promotions;
  • Publish private group discussions;
  • Harass or pressure another member;
  • Share screenshots without permission; or
  • Misuse contact information obtained through the community.

Participants should avoid posting confidential, highly sensitive, medical, financial, or personally identifying information in a group.

Although we may moderate communities, we cannot guarantee the conduct of every participant.

26. Participant Conduct

You agree to behave respectfully toward trainers, staff, partners, and other participants.

Prohibited conduct includes:

  • Abuse, threats, intimidation, or harassment;
  • Hate speech or discriminatory conduct;
  • Sexual harassment or inappropriate communication;
  • Deliberate disruption;
  • Fraud or impersonation;
  • Unauthorised solicitation or promotion;
  • Sharing another participant’s private information;
  • Distribution of pirated material;
  • Attempting to recruit participants into unrelated services without permission;
  • Recording without consent;
  • Making knowingly false allegations;
  • Interfering with the learning environment; or
  • Engaging in unlawful activity.

Xtasify may issue a warning, restrict community access, remove a participant, or terminate access depending on the seriousness of the conduct.

27. Confidentiality in Consultations and Group Programmes

Xtasify will take reasonable steps to handle private information shared during consultations and programmes responsibly in accordance with our Privacy Policy.

Participants must also respect the confidentiality of information shared by others.

You must not disclose another participant’s:

  • Personal story;
  • Identity;
  • Question;
  • Family information;
  • Business information;
  • Health-related information;
  • Photograph;
  • Recording; or
  • Private communication.

Group confidentiality depends partly on participant conduct. Xtasify cannot provide an absolute guarantee that another participant will comply with confidentiality obligations.

You should therefore exercise discretion when sharing sensitive information in a group setting.

28. Privacy and Personal Data

Our collection, use, storage, sharing, and protection of personal information are governed by our Privacy Policy.

By providing personal information, you represent that:

  • The information is accurate;
  • You are authorised to provide it;
  • You understand the purpose for which it is requested; and
  • Where you provide another person’s information, you have lawful authority or consent to do so.

Consent for optional marketing, recordings, testimonials, or other separate purposes may be requested independently.

29. Health and Wellness Disclaimer

Xtasify programmes may discuss wellness, stress, emotions, breathing, meditation, yoga, energy, habits, subconscious patterns, or personal development.

Unless expressly provided under a separate legally permitted professional engagement, this content is not intended to:

  • Diagnose a disease or disorder;
  • Prescribe treatment or medication;
  • Replace medical or psychological assessment;
  • Provide emergency intervention;
  • Replace ongoing treatment;
  • Instruct you to discontinue prescribed medication; or
  • Guarantee healing or recovery.

You should consult an appropriately qualified healthcare professional regarding medical symptoms, mental-health concerns, medication, diagnosis, treatment, or physical limitations.

Do not delay seeking professional care because of information received through an Xtasify Programme.

30. Mental-Health and Emergency Situations

Xtasify is not an emergency or crisis-response service.

Participants must not rely on a trainer, community group, recorded course, or delayed message response for emergency assistance.

31. Yoga, Pranayama, Meditation and Physical Practices

Physical, breathing, relaxation, and meditative practices may affect individuals differently.

Before participating, you are responsible for considering:

  • Your age;
  • Fitness;
  • Pregnancy;
  • Recent surgery;
  • Respiratory or cardiac conditions;
  • Blood-pressure concerns;
  • Neurological conditions;
  • Injuries;
  • Medication;
  • Psychological vulnerability; and
  • Any advice given by your healthcare professional.

You should:

  • Practise within comfortable limits;
  • Follow safety instructions;
  • Avoid forceful breath retention unless specifically suitable;
  • Stop immediately if you experience pain, dizziness, breathlessness, panic, or unusual discomfort; and
  • Seek qualified advice where necessary.

Xtasify may modify or decline participation where a practice appears unsuitable or unsafe.

32. Astrology, Vastu, Reiki and Spiritual Content

Astrology, Vastu, Reiki, chakra, energy-awareness, meditation, philosophy, and spiritual-development content may be based on traditional, interpretive, experiential, philosophical, or belief-based systems.

Such content must not be treated as:

  • A scientific certainty;
  • A guaranteed prediction;
  • A substitute for professional advice;
  • A command to make a particular decision;
  • Proof of a medical or psychological condition; or
  • A guarantee of health, wealth, marriage, business success, or any future event.

Interpretations may vary between practitioners and traditions.

You remain solely responsible for decisions involving:

  • Health;
  • Medicine;
  • Marriage;
  • Relationships;
  • Career;
  • Business;
  • Investment;
  • Property;
  • Litigation;

Xtasify does not guarantee:

  • Revenue;
  • Profit;
  • Funding;
  • Employment;

34. Personal Responsibility

Transformation and learning depend on many factors, including:

  • Participation;
  • Practice;
  • Effort;
  • Consistency;
  • Prior experience;

  • Market conditions; and
  • Factors beyond Xtasify’s control.

You remain responsible for:

  • Your decisions;
  • Your actions;
  • Your interpretation of the material;
  • The extent to which you implement suggestions;
  • Seeking professional help where necessary; and
  • Evaluating whether a practice is appropriate for you.

35. No Guarantee of Results

Programme names, descriptions, intended outcomes, examples, exercises, success stories, and promotional statements describe the purpose or potential value of the Programme.

They do not constitute a guarantee that every participant will achieve:

  • A specific emotional state;
  • Improved health;
  • Greater income or wealth;
  • Business success;
  • Relationship improvement;
  • Spiritual experiences;
  • Career advancement;
  • Permanent behavioural change; or
  • Any other particular result.

No representative is authorised to provide a guarantee unless it is expressly documented in a written agreement approved by AhaLok® Technologies Private Limited.

This section does not limit rights relating to a service that was not delivered, was materially deficient, or was misrepresented under applicable law.

36. Third-Party Platforms and Services

Xtasify may use third-party services such as:

We will nevertheless take reasonable steps to address issues that materially affect delivery of a purchased service.

A link does not necessarily constitute:

  • Sponsorship; or

41. Suspension and Termination

Xtasify may suspend or terminate Website, Programme, account, community, or content access where:

42. Discontinuation by the Participant

You may discontinue participation at any time.

However:

  • Discontinuation does not automatically create a refund entitlement;
  • Unused sessions may expire;
  • Outstanding instalments may remain payable;
  • Content access may end according to the original access period; and
  • Confidentiality and intellectual-property obligations continue after withdrawal.

43. Disclaimers

To the maximum extent permitted by law:

  • The Website and general information are provided on an “as available” basis;
  • We do not guarantee uninterrupted or error-free access;
  • We do not guarantee compatibility with every device or third-party platform;
  • We do not guarantee a particular personal or commercial outcome; and

  • Loss arising from a participant’s independent decision;
  • Loss caused by unauthorised sharing of access credentials;
  • Third-party platform failure beyond reasonable control;
  • Participant device or internet failure;
  • Loss resulting from failure to follow safety instructions; or
  • Use of Programme content outside its intended educational purpose.

Where liability cannot legally be excluded, aggregate liability relating to a particular paid service will ordinarily be limited to the amount actually paid for that service.

This limitation does not apply to:

  • Fraud;
  • Wilful misconduct;
  • Gross negligence where liability cannot be limited;
  • Death or personal injury caused by legally established negligence; or
  • Statutory consumer rights that cannot be excluded.

45. Indemnification

To the extent permitted by law, you agree to indemnify AhaLok® Technologies Private Limited, Xtasify, and their representatives against reasonable losses, claims, liabilities, and expenses resulting from:

  • Your material breach of these Terms;
  • Your unlawful use of the Website or Programme;
  • Your infringement of intellectual-property rights;
  • Your unauthorised recording or distribution;
  • Content unlawfully submitted by you;
  • Misuse of another participant’s information; or
  • Fraudulent or abusive conduct.

This obligation will be applied only to the extent that the relevant loss was caused by your conduct.

46. Force Majeure

Xtasify will not be responsible for delay, interruption, modification, or failure caused by circumstances beyond reasonable control, including:

  • Natural disasters;
  • Fire or flood;
  • Epidemics or pandemics;
  • War or civil disturbance;
  • Government orders;
  • Strikes;
  • Venue closures;
  • Transport disruption;
  • Serious illness or emergency;
  • Power or internet failure;
  • Cyber incidents;
  • Platform outages; or
  • Failure of essential third-party providers.

We will make reasonable efforts to:

  • Reschedule;
  • Change the delivery mode;
  • Provide replacement access;
  • Extend access;
  • Offer programme credit; or
  • Provide another reasonable solution.

48. Governing Law

These Terms are governed by the laws of India.

The parties will first attempt to resolve disputes through good-faith written communication.

Subject to mandatory rights and forums available under consumer-protection or other applicable law, disputes will be subject to the jurisdiction of competent courts in Khargone, Madhya Pradesh, India.

Nothing in this section restricts a consumer from approaching a legally competent consumer commission or statutory authority.

49. International Users

Users accessing Xtasify services from outside India are responsible for determining whether the Programme and its content are lawful and appropriate in their location.

Unless expressly agreed otherwise:

  • The service is offered from India;
  • Payments and contracts are governed by Indian law;
  • The participant is responsible for local taxes or legal requirements; and
  • Xtasify does not represent that every Programme complies with every foreign professional or regulatory system.

  • Programme formats;
  • Technology;
  • Business practices;
  • Safety requirements;
  • Law; or
  • Regulatory guidance.

The updated Terms will be published with a revised effective date.

For an existing paid transaction, the terms disclosed at the time of purchase will ordinarily continue to govern that transaction unless:

  • The change is required by law;
  • The participant agrees to the change;
  • The change is administrative and does not materially reduce rights; or
  • The revised term is more favourable to the participant.

Continued use of the Website after publication of revised general Website terms constitutes acceptance of those terms.

51. Electronic Agreement and Notices

You agree that electronic actions may constitute valid acceptance, including:

  • Representative authority; or
  • Right to bind Xtasify or AhaLok® Technologies Private Limited.

Participants must not represent themselves as employees, authorised trainers, agents, certified practitioners, or official representatives unless separately authorised in writing.

54. Waiver

Failure by Xtasify to enforce a provision on one occasion does not constitute a permanent waiver of that provision.

Any waiver must be expressly communicated in writing by an authorised representative.

55. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary.

The remaining provisions will continue in effect.

56. Survival

Provisions concerning the following will continue after completion, withdrawal, suspension, or termination:

  • Intellectual property;
  • Confidentiality;
  • Privacy;
  • Outstanding payments;
  • Participant content;
  • Disclaimers;
  • Limitation of liability;
  • Indemnification;
  • Dispute resolution; and
  • Governing law.

57. Entire Agreement

These Terms, together with the Privacy Policy, Refund & Cancellation Policy, programme-specific disclosures, payment terms, and any written proposal or agreement, constitute the complete agreement relating to the relevant service.

They replace earlier oral or written discussions concerning the same subject, except where an authorised written agreement expressly states otherwise.

58. Language

These Terms may be made available in Hindi or another language for convenience.

Where there is an inconsistency between translations, the English version will prevail to the extent permitted by applicable law, unless a programme-specific agreement states otherwise.
